Why serious injuries often take longer to settle in Massachusetts

Serious injury cases often take longer because the full impact of your injuries is not clear right away. Settling too soon in Massachusetts can mean you miss out on compensation for future medical care or long-term problems that show up later.

Medical recovery must reach a stable point

One major reason for delays is waiting until you reach maximum medical improvement. This means your condition has healed as much as doctors expect it will.

Before that point, doctors may not know what treatment you will still need. Serious injuries often require ongoing care, physical therapy or permanent work limits. Until your recovery is clearer, it is hard to know what your case is really worth.

High-value claims face closer scrutiny

Serious injuries usually lead to higher settlement amounts. Because more money may be involved, insurance companies tend to look at these claims more carefully.

This often causes delays. Insurers may ask for medical records more than once, request extra exams or question how serious your injuries are. Even when fault seems clear, these steps can slow the process.

Evidence and liability issues take time to resolve

Strong evidence is required to support a serious injury claim. This may include records from multiple doctors, expert opinions or reports explaining how the accident happened.

Under the state’s statute of limitations (M.G.L. c. 260, § 2A), most personal injury lawsuits must be filed within three years of the injury date. Filing an insurance claim alone does not stop this deadline.

If negotiations fail and a lawsuit becomes necessary, the pace often slows further. Court calendars, discovery and motion practice can add months or even years before a case reaches trial or resolution.
